1.1 Contracting Party. These Terms of Service, together with any documents expressly incorporated by reference into them (collectively, the "Terms"), constitute a single, legally binding and enforceable agreement made between you, the individual accessing or using the Service (referred to as the "Participant", "you" or "your"), and Ashish Dua, an individual acting in his disclosed capacity as the owner, operator, sole proprietor and independent consultant carrying on the DuaDesk business (referred to as the "Service Provider", "I", "me", "my", "we" or "us"). The subject matter of this agreement is your access to, browsing of, booking of, participation in and use of Dua Pandit Ji and all related and associated websites, web applications, mobile applications, software, application programming interfaces, audiovisual materials, artificial-intelligence systems and models, digital avatar and voice technologies, recordings, content, keepsakes, features and services, whether provided online or offline and whether existing now or introduced in the future (collectively, the "Service").
By clicking to accept these Terms, by completing a booking, by making a payment, or by otherwise accessing or using any part of the Service, you confirm that you have read, understood and agreed to be bound by these Terms on your own behalf and on behalf of any person you are authorised to represent. If you do not agree to these Terms in their entirety, you must not access or use the Service.
1.2 Business Identity and Absence of Separate Legal Personality. "DuaDesk" is the trading name of the business and platform through which Ashish Dua, in his individual proprietary capacity, develops, hosts, markets and provides artificial-intelligence-enabled products and services. "Dua Pandit Ji" is a proprietary product, brand and technology-enabled ceremonial experience likewise owned and operated by Ashish Dua. These names identify the relevant business, product or service carried on by Ashish Dua as a sole proprietor and do not constitute or imply any separate company, corporation, partnership, firm, trust or other legal person.
Unless and until a separately constituted legal entity is lawfully created and expressly identified as the operator of the Service in updated consumer-facing documentation, the contracting party for all purposes shall be Ashish Dua in his individual proprietary capacity, and any attempt to attribute the Service to, or to pursue a claim against, a non-existent or unrelated entity shall be of no effect.
1.3 Capacity and Scope of Contractual Obligations. Ashish Dua enters into and performs these Terms in his disclosed business capacity as the owner, operator and sole proprietor of the DuaDesk business and Dua Pandit Ji service. Because the Service is operated as a proprietorship, nothing in these Terms is intended to create a separate legal personality or to suggest that the proprietorship itself is legally distinct from Ashish Dua. At the same time, the parties agree that all contractual rights, duties, representations and remedies relating to the Service are governed by these Terms, subject always to applicable law and to liabilities that cannot lawfully be excluded or limited. No additional personal, fiduciary, professional, priestly, religious or advisory undertaking shall be implied merely because Ashish Dua is identified as founder, creator, promoter, presenter, narrator, voice, face, avatar, spokesperson or public representative of the Service.
All obligations owed to a Participant arise exclusively under and are limited by these Terms, and no additional, collateral, implied or personal obligation shall be imputed to Ashish Dua by reason of his identity, prominence, public association with the Service, or appearance within the digital avatar or any recording.
1.4 Nature of the Service. Dua Pandit Ji is a technology-enabled, artificial-intelligence-guided ceremonial experience intended for cultural, educational, personal, celebratory and keepsake purposes. An artificial-intelligence system and/or a digital avatar may present explanations, sequencing, cues, prompts, translations and audiovisual guidance to assist Participants, and Participants themselves perform any customary rituals in their own physical environment and under their own direction and control. Mantras, chants and recitations may be delivered through recordings made by qualified human practitioners, and/or through other authorised, licensed or lawfully used content.
The Service is a private, technology-based experience only. It is expressly not represented to be, and must not be understood or relied upon as, the services of a human priest, a religious authority, a spiritual guru, a Marriage Officer, a Registrar, a government authority or office, an advocate or legal practitioner, a notary, a licensed counsellor, or any other regulated, licensed or statutory professional or office-bearer. Any resemblance of the experience to a traditional ceremony is provided for cultural and commemorative purposes and does not convert the Service into a regulated religious, legal or governmental act.
1.4A Synthetic Avatar and Digital Representation. The Participant acknowledges that the digital representation used in the Service may be synthetic, artificial-intelligence-generated, pre-recorded, algorithmically generated or otherwise digitally rendered. Its appearance, voice or behaviour does not constitute a live physical appearance, personal attendance or human priestly officiation by Ashish Dua. No Participant should infer from the avatar that Ashish Dua is physically present at, supervising, or personally conducting the ceremony.
1.5 No Legal Solemnisation, Certification or Registration. The Service does not itself solemnise, perform, register, record, certify, validate, authenticate or guarantee any legally recognised marriage, union, civil status or other legal status whatsoever, and it confers no legal rights, entitlements or recognitions of any kind. The completion of a session, ceremony, sequence, digital record, on-screen declaration, certificate, keepsake, image, video or other output does not constitute, evidence or substitute for solemnisation under any personal or civil marriage law, government registration, statutory certification, or any official or legal act, and no such output has any evidentiary or legal effect before any authority, court or third party.
The Participant is, and at all times remains, solely and exclusively responsible for satisfying every applicable legal requirement connected with any marriage, ceremony or status the Participant may wish to establish, including without limitation all requirements relating to eligibility, minimum age, mental capacity, free and valid consent, prohibited degrees of relationship, subsisting marriages, required notices, statutory declarations, witnesses, documentation, venue permissions, and registration with the competent authority. The Participant acknowledges that the Service Provider has made no representation that any legal status will result from the use of the Service, and the Participant assumes all responsibility and risk for independently obtaining any legal recognition the Participant desires.
1.6 Religious, Cultural and Traditional Variation. Hindu ceremonies, rites, customs, sequences and practices vary widely and legitimately according to family, region, language, community, lineage, sampradaya, tradition, scholarly opinion and individual practitioner, and reasonable and learned persons may differ as to what is correct, complete, authentic or appropriate. The Service provides one structured, technology-enabled rendering intended to be broadly respectful and accessible, and the Service Provider makes no representation, warranty or claim that any particular sequence, selection, mantra, translation, transliteration, pronunciation, timing, gesture or interpretation offered through the Service is universally authoritative, doctrinally correct, complete, or suitable for the Participant's own family, tradition or requirements.
The Participant is responsible for determining whether the experience is acceptable and appropriate for the Participant's own beliefs and traditions, and any dissatisfaction arising from differences of religious, cultural or traditional opinion shall not, of itself, constitute a defect in the Service or a breach of these Terms.
1.6A No Religious Office or Authority. Unless expressly stated in writing, neither Ashish Dua nor Dua Pandit Ji represents or warrants that Ashish Dua holds any particular religious office, priestly lineage, sampradaya, spiritual title or ecclesiastical authority. The Service is a technology-enabled ceremonial guidance experience and should not be represented by Participants to third parties as an official religious, governmental or statutory certification.
1.7 Eligibility and Participant Warranties. You represent, warrant and undertake to the Service Provider, on a continuing basis for so long as you use the Service, that you are at least eighteen (18) years of age or such higher age of majority as may apply to you; that you possess the full legal right, capacity, authority and competence to enter into and to perform these Terms; that you are participating of your own free will and without coercion, undue influence or misrepresentation; that you are not barred, disqualified or prohibited from using the Service or from entering into these Terms by any applicable law, order or agreement binding upon you; and that where you act on behalf of another person or persons, you have obtained all authority and consents necessary to bind them.
You further represent and warrant that all information you submit to the Service is true, accurate, current and complete, that you will keep it updated, and that you will not impersonate any person or misrepresent your identity, age, eligibility or affiliation. You acknowledge that the Service Provider relies upon these warranties in agreeing to provide the Service to you.
1.8 Participant Responsibilities. You are solely and fully responsible for the accuracy, completeness and lawfulness of all information, names, details and materials that you provide in connection with the Service. You are solely responsible for obtaining, before any session, every consent that is legally required from your guests, your co-participant, and any other person whose personal data, image or voice may be involved in or captured during the ceremony, and for ensuring that all such persons have been given any notice the law requires.
You are solely responsible for your own compliance with all laws applicable to you, including any laws relating to marriage, ceremonies, gatherings, public order, and the conduct of the event. You are solely responsible for independently arranging and completing any marriage registration, statutory formality or official requirement that you wish to fulfil, none of which the Service performs on your behalf. You are solely responsible for providing and maintaining the devices, internet connectivity, electrical power, software, and technical environment required to access the Service. Finally, you are solely responsible for the physical safety of yourself, your co-participant, your guests and your surroundings when you choose to perform any ritual or activity involving fire, havan, flame, smoke, incense, candles, oil lamps, heated objects, electrical equipment or any other physical material, and for taking all reasonable safety precautions in respect of such activities.
1.9 Artificial-Intelligence and Technology Limitations. The Service depends upon a range of technologies and external dependencies over which the Service Provider has limited or no control, including internet connectivity, telecommunications networks, cloud and hosting infrastructure, artificial-intelligence systems and models, machine-learning outputs, speech and audiovisual systems, digital-avatar rendering, third-party application programming interfaces, and other external services. You acknowledge and accept that artificial-intelligence and automated outputs are probabilistic and imperfect by their nature and may, from time to time, contain inaccuracies, omissions, errors of fact, translation, transliteration, pronunciation, sequencing or timing, unexpected or inappropriate responses, latency, interruptions, distortions or technical artefacts.
No representation, warranty or guarantee is made that the Service will be uninterrupted, timely, secure, error-free, complete, accurate, or compatible with your particular device, software or environment, or that any defect will be corrected. You must at all times exercise your own independent judgment, and you must pause, modify or discontinue any activity immediately if the safety, accuracy, appropriateness or comfort of that activity is in any doubt. Your continued use of the Service constitutes acceptance of these inherent limitations.
1.10 No Reliance on the Service as Professional Advice. Any information, explanation, guidance, translation, suggestion or output provided by or through the Service is general ceremonial, cultural, educational and informational content only. It is not, and must not be treated or relied upon as, legal advice, matrimonial or family-law advice, financial, accounting or tax advice, medical, health, psychological or counselling advice, or advice of any other professional, regulated or specialist nature, and no professional-client, advisory, fiduciary or similar relationship is created between you and the Service Provider by your use of the Service.
You should obtain independent advice from an appropriately qualified and, where relevant, licensed professional whenever your circumstances call for it, and you assume full responsibility for any decision you make or action you take in reliance on information obtained from the Service.
1.10A No Guaranteed Spiritual or Other Outcome. No ritual, mantra, sequence, ceremonial act, translation, pronunciation or other content supplied through the Service is represented as guaranteeing any spiritual, religious, matrimonial, financial, health or other outcome.
1.11 Prohibited Conduct. You shall not, and shall not attempt to, and shall not permit or assist any other person to, engage in any of the following in connection with the Service: to copy, scrape, crawl, harvest, extract, mirror, cache (other than ordinary browser caching), reproduce, republish, distribute, transmit, display or perform the Service or any of its content except as expressly permitted by these Terms; to reverse engineer, decompile, disassemble, decrypt or otherwise attempt to derive the source code, structure, models, weights, architecture or underlying ideas of the Service; to sell, resell, rent, lease, lend, sublicense, assign, transfer or otherwise commercially exploit the Service or access to it; to create derivative works from, or to adapt or modify, the Service or any Proprietary IP; or to use the Service, its content, its outputs or any recording to develop, train, fine-tune, evaluate or improve any artificial-intelligence system, model, dataset, avatar or competing product, in each case except with the prior express written authorisation of the Service Provider.
You further shall not impersonate Dua Pandit Ji, DuaDesk or Ashish Dua or any other person; misrepresent your affiliation with any of them; circumvent, disable, probe or interfere with any security, authentication, access-control or usage-limitation feature; introduce any virus, malware or harmful code; overload, disrupt or impair the operation of the Service or its infrastructure; upload, transmit or make available any content that is unlawful, infringing, defamatory, obscene, harassing, hateful, threatening or otherwise objectionable; or use the Service to harass, abuse, defame, threaten, stalk, deceive or infringe the rights of any person. Any breach of this clause is a material breach of these Terms.
1.12 Intellectual Property. All right, title and interest, including all intellectual-property rights, in and to Dua Pandit Ji and DuaDesk and each of their names, brands, trade names, trade marks (whether registered or unregistered), service marks, get-up and trade dress, domains, software, source and object code, algorithms, models, application programming interfaces, user interfaces, workflows, processes, methods, prompts, prompt-engineering, scripts, screenplays, storyboards, sequences, designs, layouts, graphics, artwork, logos, audiovisual materials, animations, music, sound, artificial-intelligence configurations and fine-tunings, digital-avatar and voice technologies, documentation, proprietary recordings, compilations, databases, and all other proprietary materials and content (collectively, the "Proprietary IP"), are and shall remain owned exclusively by Ashish Dua, or are used by Ashish Dua under a valid and subsisting licence from a third-party rights holder.
Nothing in these Terms, and nothing in your access to or use of the Service, transfers, assigns or grants to you any ownership of or any right, title or interest in the Proprietary IP, other than the limited right expressly granted in this clause. Subject to your payment of all applicable fees and your continuing compliance with these Terms, the Service Provider grants you only a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable and non-commercial licence to access and use the Service, and to retain and use any permitted personal keepsake generated for you, strictly for your own private, personal and non-commercial ceremonial purposes and for no other purpose. All rights not expressly granted to you are reserved to Ashish Dua and the relevant licensors.
1.13 Founder, Owner and Identity Rights of Ashish Dua. To the extent recognised under applicable law, Ashish Dua retains all rights and interests he lawfully possesses in his name, image, photograph, portrait, likeness, face, voice, speech, signature, persona, biography, mannerisms, performances and other identifiable attributes of his identity and personality (collectively, the "Identity Attributes"). Your access to or use of the Service, including interaction with any digital avatar, grants you no ownership or independent commercial right in the Identity Attributes.
You shall not, without the prior express written authorisation of Ashish Dua, reproduce, record, capture, publish, broadcast, distribute, edit, alter, manipulate, deepfake, synthesise, imitate, commercialise, license, sell, clone, use to train or condition any artificial-intelligence system or model, create any competing or derivative avatar, voice model or likeness from, or otherwise exploit, any of the Identity Attributes or the digital avatar. The digital avatar is a technology-based representation created and controlled by Ashish Dua, and its provision through the Service is not, and shall not be construed as, a sale, assignment, waiver or transfer of any of the Identity Attributes or of any right in them. Any unauthorised use of the Identity Attributes is expressly prohibited and shall entitle Ashish Dua to pursue all available legal and equitable remedies.
1.14 Third-Party Content and Services. The Service may be provided with the assistance of, or may interoperate with, third-party products and services, including artificial-intelligence, avatar and voice providers, cloud, hosting and storage providers, content and licensing providers, payment processors, email, messaging and communications providers, analytics providers, and security providers. Such third parties act under their own terms and policies, and the Service Provider does not control and is not responsible or liable for the independent acts, omissions, delays, interruptions, outages, defaults, security incidents, pricing, terms or policies of any third party, except and only to the extent that such liability cannot lawfully be excluded.
Where any part of the Service links to or integrates with a third-party site or service, that site or service is governed by its own terms, and your dealings with it are solely between you and that third party.
1.15 User Content. You retain such rights as you lawfully hold in any content, information, names, images, text or other material that you submit, upload or provide to the Service ("User Content"), and you represent and warrant that you have all rights and consents necessary to submit it. You grant to the Service Provider a limited, non-exclusive, royalty-free, worldwide licence to host, store, reproduce, transmit, display, process and adapt User Content solely to the extent reasonably necessary to provide, operate, secure, administer, troubleshoot and support the Service, to create the specific keepsake or output requested by you, to comply with law, to resolve disputes and to enforce these Terms, in each case subject to the Privacy Notice and to applicable law.
No licence to use the User Content for advertising, marketing, publicity, testimonial, demonstration, case-study or other promotional purposes is granted or implied by this clause; any such use is governed separately by the publicity provisions of these Terms and requires your distinct opt-in consent where the law so requires. User Content will not be used to train or fine-tune any general-purpose artificial-intelligence model except where you have separately authorised this or where it is otherwise lawfully permitted.
1.16 Recording. Recording of any session is optional and is switched off by default, and no recording will occur unless and until you expressly and affirmatively select and enable it. Where recording is enabled, the separate Recording & Consent Notice set out in these documents applies in addition to these Terms and forms part of your agreement. You are responsible for ensuring that every person whose image, voice, likeness or personal data may be captured in a recording has been given any notice, and has provided any consent, that the law requires before the recording takes place, and the Service Provider may rely on your confirmation that all such consents have been obtained.
1.17 Publicity. The use of a Participant's name, image, photograph, voice, likeness, testimonial or ceremony recording for advertising, marketing, promotion, demonstrations, case studies, social-media, website or any other publicity purpose is never a condition of purchasing or using the Service, and will only be undertaken on the basis of a separate, specific, informed and affirmative opt-in consent given by the relevant person where such consent is required by law. Any such consent is voluntary and may be withdrawn for future uses in the manner described in the relevant consent, subject to uses already lawfully made and to lawful retention requirements.
1.18 Fees and Taxes. The fees payable for the Service are those displayed to you at the point of checkout or as otherwise agreed in writing, are stated and payable in the currency indicated, and are exclusive of and subject to all applicable taxes, levies, duties and charges, including goods and services tax, which shall be borne by you where the law so provides. Payment may be collected and processed through one or more third-party payment providers under their own terms, and you authorise the charging of the applicable fees and taxes to your chosen payment method. Except as expressly provided in the Cancellation & Refund Policy or as required by law, all fees are payable in advance and are non-refundable.
1.19 Cancellation and Refunds. Cancellation of a booking and any entitlement to a refund are governed by the separate Cancellation & Refund Policy set out in these documents, which forms part of these Terms, and which applies subject at all times to any non-waivable consumer or statutory rights that you may have and that cannot lawfully be excluded or limited.
1.20 Suspension and Termination. The Service Provider may, at its reasonable discretion and where reasonably necessary, suspend, restrict, limit or terminate your access to the Service, or any part of it, whether temporarily or permanently and with or without prior notice, including for reasons of legal or regulatory compliance, safety, security, prevention or investigation of fraud or abuse, protection of the Proprietary IP or Identity Attributes, actual or suspected misuse of the Service, abusive, unlawful or harmful conduct, non-payment, or any material or persistent breach of these Terms by you.
Termination or suspension shall not affect any right, remedy, obligation or liability that has accrued before it takes effect, nor any provision of these Terms that is expressly or by its nature intended to survive termination, including provisions relating to intellectual property, identity rights, disclaimers, limitation of liability, indemnity, dispute resolution and governing law, all of which shall continue in full force.
1.21 Disclaimer of Warranties. To the maximum extent permitted by applicable law, the Service and all of its content, features and outputs are provided on an "as is" and "as available" basis, with all faults and without any warranty, representation, condition or guarantee of any kind, whether express, implied, statutory or otherwise, and the Service Provider expressly disclaims, to the fullest extent the law allows, all implied warranties and conditions of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, title and non-infringement.
Without limiting the generality of the foregoing, the Service Provider gives no warranty and makes no representation that any marriage, union or status will be legally recognised, that the Service conforms to any particular religious, doctrinal or traditional standard, that any pronunciation, translation, sequence or timing is correct or complete, that the Service will be available, uninterrupted, secure or error-free, or that any particular outcome, benefit or result not expressly promised in these Terms will be achieved. No advice or information, whether oral or written, obtained from the Service or the Service Provider creates any warranty not expressly stated in these Terms. Nothing in this clause excludes any warranty or right that cannot lawfully be excluded.
1.22 Limitation of Liability. To the maximum extent permitted by applicable law, and subject always to the final paragraph of this clause, the total aggregate liability of the Service Provider to you, whether arising in contract, tort (including negligence), breach of statutory duty, restitution or otherwise, and arising out of or in connection with any particular booking, transaction, session or use of the Service, shall in no event exceed the amount actually paid by you to the Service Provider for that particular booking, transaction or session giving rise to the claim.
To the maximum extent permitted by applicable law, the Service Provider shall not be liable for any indirect, incidental, special, punitive, exemplary or consequential loss or damage, nor for any loss of profit, revenue, business, goodwill, reputation, opportunity, anticipated savings, contracts or data, nor for any business interruption, nor for any loss or damage arising from your reliance on the Service, from any inaccuracy or error in any artificial-intelligence output, from any interruption, delay or failure of the Service, or from the act, omission or default of any third party outside the Service Provider's reasonable control, in each case whether or not the Service Provider had been advised of, or could have foreseen, the possibility of such loss or damage. Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by the Service Provider's own negligence and liability for his own fraud or fraudulent misrepresentation; and where any such liability arises, these limitations shall apply to the fullest extent the law permits but no further.
Nothing in this clause limits the Service Provider's right to seek injunctive, equitable or other appropriate relief in respect of actual or threatened infringement or misuse of intellectual property, confidentiality, security, Identity Attributes, likeness, voice, persona or other proprietary rights, subject to applicable law.
1.23 Participant Indemnity. To the maximum extent permitted by applicable law, you shall indemnify, defend and hold harmless Ashish Dua, together with the DuaDesk business and the Dua Pandit Ji brand and any of his agents, contractors and successors, from and against any and all third-party claims, demands, actions, proceedings, liabilities, losses, damages, penalties, fines, costs and expenses (including reasonable legal and professional fees and the costs of enforcing this indemnity) that arise out of or are connected with any of the following: your breach or alleged breach of these Terms; your unlawful, unauthorised or improper access to or use of the Service; any infringement or violation of the rights of a third party caused by any User Content or other material supplied by you; your failure to obtain any consent required from a guest, co-participant or other person; your failure to comply with any marriage, ceremony, registration or other legal requirement applicable to you; your misuse, misrepresentation or unauthorised distribution of any recording or Service output; and any unsafe, negligent or improper physical performance of any ritual, activity or setup under your direction or control.
This indemnity shall not apply to the extent that a claim is finally determined by a competent court or tribunal to arise from a liability that cannot lawfully be shifted to you, or from the Service Provider's own fraud, or from death or personal injury caused by the Service Provider's own negligence. The Service Provider shall notify you of any claim to which this indemnity applies, shall allow you a reasonable opportunity to participate in the defence, and shall not settle any such claim in a manner that imposes a non-indemnified obligation on you without your consent, such consent not to be unreasonably withheld.
1.24 Physical Ritual Safety. Any fire, havan, flame, oil lamp, candle, incense, smoke, heated object, electrical equipment, decoration, seating, staging, venue or other physical element that is used, arranged or created during or in connection with a ceremony is and remains entirely under the control, direction and responsibility of the Participants, their guests and the venue, and never under the control of the Service Provider. The Service Provider does not attend, supervise, inspect, manage or control the physical environment in which any ceremony takes place, and makes no representation, warranty or assurance that any particular physical arrangement, material or activity is safe, suitable, permitted or lawful for any particular location, venue, structure or person.
The Participants are solely responsible for complying with all applicable venue rules, tenancy conditions, fire-safety and building-safety requirements, local regulations and reasonable safety precautions, for keeping fire, flame and heat away from persons, clothing, decorations and combustible materials, for maintaining adequate ventilation and supervision, and for having appropriate safety measures in place. The Participants assume all risk arising from the physical conduct of the ceremony.
1.25 Force Majeure. The Service Provider shall not be in breach of these Terms, nor liable for any delay in performing, or any failure to perform, any of his obligations, where and to the extent that the delay or failure results from any event or circumstance beyond his reasonable control, including without limitation any act of God, natural disaster, flood, earthquake, fire or storm, epidemic or pandemic and any measures taken in response to it, war, terrorism, riot, civil disturbance or insurrection, act or omission of government or any authority, change in law, embargo or sanction, failure or interruption of power, telecommunications, internet, cloud, hosting or other utility or infrastructure, cyberattack, malware, denial-of-service attack or security breach not attributable to the Service Provider's own wilful default, failure or default of any third-party service or supplier, labour dispute or shortage, or any other similar event.
During the continuance of such an event the Service Provider's obligations shall be suspended to the extent affected, and where the event prevents performance for a material period the Service Provider may, where reasonably practicable and subject to the Cancellation & Refund Policy, offer rescheduling or an appropriate refund in full and final satisfaction of any claim arising from the affected performance.
1.26 Governing Law and Dispute Resolution. The parties shall use reasonable endeavours to resolve any dispute, controversy or claim arising out of or in connection with these Terms or the Service amicably and in good faith. A party wishing to raise a dispute should first give written notice to the other party and allow a reasonable period for good-faith discussion. This does not prevent either party from seeking urgent injunctive or interim relief where necessary to protect intellectual property, Identity Attributes, confidentiality, security or other rights, and does not restrict any mandatory statutory or consumer remedy.
Subject to any mandatory consumer-protection or other statutory right that entitles you to bring proceedings in another forum or under another law and that cannot lawfully be excluded, these Terms and any dispute arising out of or in connection with them or the Service, including any non-contractual dispute, shall be governed by and construed in accordance with the laws of India, and the courts at Gurgaon (Gurugram), India shall have jurisdiction. Any mediation or arbitration mechanism, together with its seat, language, governing rules and the number of arbitrators, is to be settled and confirmed by qualified Indian counsel before publication, and should be adopted only where counsel confirms that it is lawful, appropriate for the Service, and does not unlawfully restrict a consumer's statutory rights.
1.27 Evidence and Electronic Acceptance. You agree that your electronic acceptance of these Terms, together with booking records, account records, consent records, checkbox selections, version identifiers, timestamps, payment and transaction records, communications, IP and device information, and system, security and access logs, may be created, maintained and stored by the Service Provider and by his processors, and may be produced and relied upon as evidence of the existence and terms of the agreement between us, of your acceptance of these Terms and of the applicable version, and of the consents you have given, in any dispute, proceeding or investigation, subject to applicable law. You agree not to dispute the admissibility or evidentiary value of such records solely on the ground that they are in electronic form.
1.28 Severability, Waiver, Variation and Assignment. If any provision or part of a provision of these Terms is or becomes invalid, illegal or unenforceable under any applicable law, it shall to that extent be deemed modified to the minimum degree necessary to make it valid, legal and enforceable while preserving as far as possible the parties' original intention, and if such modification is not possible the relevant provision or part shall be deemed severed, and in either case the validity and enforceability of the remaining provisions shall not be affected. No failure or delay by the Service Provider in exercising any right or remedy under these Terms shall operate as a waiver of that or any other right or remedy, and no single or partial exercise shall preclude any further exercise.
The Service Provider may vary these Terms from time to time by publishing an updated version, which shall apply to bookings made after it takes effect. You may not assign, transfer, charge or otherwise deal with any of your rights or obligations under these Terms without the prior written consent of the Service Provider. The Service Provider may assign, novate, transfer or otherwise deal with his rights and obligations under these Terms, and may transfer the DuaDesk business, the Dua Pandit Ji brand, the Proprietary IP or the Service, in whole or in part, to any successor, purchaser, or newly constituted legal entity, subject to applicable law and to the protection of your rights under these Terms.
1.28A No Partnership, Agency or Employment. Nothing in these Terms creates or is intended to create a partnership, joint venture, agency, employment, fiduciary or representative relationship between the Participant and the Service Provider.
1.29 Entire Agreement. These Terms, together with the Privacy Notice, the Recording & Consent Notice and the Cancellation & Refund Policy set out in these documents and any other document expressly incorporated by reference, constitute the entire agreement between you and the Service Provider concerning the Service, and supersede and extinguish all prior and contemporaneous agreements, promises, assurances, representations and understandings between you and the Service Provider, whether written or oral, relating to that subject matter. Except in the case of fraud, neither party has any remedy in respect of any statement, representation, assurance or warranty that is not expressly set out in these documents. Nothing in this clause limits any liability or right arising under mandatory law.
1.29A Booking-Specific Service Description. The specific features, inclusions, duration, deliverables and technical specifications applicable to a particular booking are those expressly displayed at checkout or otherwise confirmed in writing for that booking. The Service may evolve, and future features are not promised unless expressly included in the applicable booking.
1.30 Notices. Any notice or communication to the Service Provider under or in connection with these Terms shall be given in writing and sent to ashish@ashishduacorporation.com or to the business address stated above, and any notice to you may be given to the email address or contact details associated with your booking or account. Notices shall be deemed received at the time ordinarily expected for the method used, subject to applicable law.

Personal data may be processed for the purposes of providing, operating, personalising and administering the Service; communicating with you and responding to your enquiries and requests; processing your bookings, payments and transactions; creating, producing and delivering any keepsake or output you have requested; recording, evidencing and managing the consents you and others have given; maintaining the security, integrity and proper functioning of the Service; detecting, preventing and investigating fraud, abuse, misuse and security incidents; complying with applicable legal, regulatory, tax and accounting obligations; establishing, exercising and defending legal claims and resolving disputes; and enforcing these documents. Personal data will only be used for direct marketing or promotional purposes where you have given any consent that the law requires, and you may withdraw such consent at any time.
2.4 Processors and Sharing. The Service Provider may engage third-party service providers to process personal data on his behalf and under his instructions, including cloud, hosting and storage providers, artificial-intelligence and avatar providers, payment processors, email, messaging and communications providers, analytics providers, and security providers. Appropriate contractual and technical safeguards should be maintained with such processors, obliging them to process personal data only as instructed and to protect it appropriately. Personal data may also be disclosed where reasonably necessary to comply with a legal obligation, court order or lawful request, to protect the rights, property or safety of the Service Provider or others, to prevent or investigate wrongdoing, or in connection with a transfer of the business or its assets, in each case subject to applicable law. Personal data is not sold.
2.5 Location of Processing and Cross-Border Access. Personal data is stored and processed in the region or regions actually used by the Service and its authorised processors at the relevant time, and any statement about storage location, processing location, overseas access or cross-border processing will reflect the actual technical architecture and processor arrangements in operation and will not be represented as confined to a single country unless that is factually accurate. Where any processing, storage or access occurs outside India, or a processor is located outside India, the Service Provider will comply with the requirements governing such transfers under applicable law and will implement or rely upon appropriate contractual and technical safeguards to protect the personal data to the standard required by applicable law.
2.5A Data Residency and Hosting Location (Recordings). Recording is an optional additional service. It is off by default and is provided only where you separately choose and enable a keepsake recording for your ceremony. Where you enable it, your keepsake recording and its backups are hosted in a single region, India, and Ashish Dua remains the Data Fiduciary responsible for your personal data under applicable data-protection law, including the Digital Personal Data Protection Act, 2023 and the Digital Personal Data Protection Rules, 2025. Limited technical processing strictly necessary to create, encode, secure and deliver the recording may occur as part of providing the Service. Your recording choice is recorded together with your consent, and any recording is retained and deleted in accordance with this Notice and the Recording & Consent Notice. Any statement about the storage or processing location of a recording reflects the arrangements actually in operation at the relevant time, and storage will not be represented as confined to India unless that is factually correct for your recording.
2.6 Security and Security Incidents. The Service Provider shall implement and maintain reasonable technical, organisational and administrative safeguards designed to protect personal data against unauthorised or unlawful access, use, disclosure, alteration, loss or destruction, appropriate to the nature, scope and risks involved. No internet transmission or electronic storage system can be guaranteed to be completely secure. If the Service Provider becomes aware of a personal-data security incident affecting personal data processed through the Service, he shall assess, contain, investigate and respond to the incident and make such notifications, disclosures and remedial measures as are required by applicable law.
2.7 Retention. Personal data shall be retained only for as long as is reasonably necessary to fulfil the purposes for which it was collected, to comply with legal, regulatory, tax and accounting obligations, to maintain security, to resolve disputes, to establish, exercise or defend legal claims, and to keep lawful business records. Where recording is enabled, any keepsake recording shall ordinarily be retained for approximately 30 days following its delivery to you and shall then be deleted from active systems, subject to any longer retention that is required or permitted by law and subject to routine backup cycles from which residual copies are overwritten or purged in the ordinary course. When personal data is no longer required, it shall be securely deleted, destroyed or anonymised.
2.8 Your Rights. Subject to and in accordance with applicable data-protection law, and subject to verification of your identity, you may exercise such rights as the law affords you in respect of your personal data, which may include the right to access and obtain a copy of your personal data, to have inaccurate data corrected or completed, to have data erased or its processing restricted in defined circumstances, to withdraw a consent you have given (without affecting the lawfulness of processing before withdrawal), to nominate a person to exercise your rights in the event of death or incapacity where the law so provides, and to seek grievance redressal. To exercise any such right, please contact Ashish Dua, the grievance-redressal contact, at ashish@ashishduacorporation.com or +91 88600 36003 / +91 88600 46004.
2.9 Withdrawal of Consent. Where processing is based on your consent, you may withdraw that consent at any time in respect of future processing. Withdrawal of consent takes effect prospectively and does not affect the lawfulness of any processing already carried out on the basis of your consent before its withdrawal, and does not require the deletion of personal data where its retention is required or otherwise permitted by law, is necessary for the performance of a legal obligation, or is necessary for the establishment, exercise or defence of legal claims. Withdrawal of consent that is necessary for the provision of a particular feature may prevent the Service Provider from continuing to provide that feature to you.
2.10 Complaints and Changes to this Notice. If you have any complaint or concern about how your personal data is handled, you may raise it with Ashish Dua, the grievance-redressal contact, at ashish@ashishduacorporation.com or +91 88600 36003 / +91 88600 46004, and you may also have the right to complain to the Data Protection Board of India or other competent authority under applicable law. This Privacy Notice may be updated from time to time to reflect changes in the law, in technology, in the Service or in the Service Provider's practices, and the updated version shall apply from the date it is published or otherwise notified to you in accordance with applicable law.
3. RECORDING & CONSENT NOTICE
This notice is presented before any recording-enabled Dua Pandit Ji session and forms part of your agreement where recording is enabled.
3.1 Optional Recording. Recording of your session is entirely optional and is disabled by default. If you do not provide your consent, recording of the ceremony will not be enabled, save only to the limited extent that a technical, operational or security log is strictly necessary for the functioning and protection of the Service and is lawfully permitted, which log is not a keepsake recording of the ceremony.
3.2 What Is Captured. Where you have consented and recording is enabled, the system may capture audiovisual content of the session, which may include the image, appearance, voice, speech, words, actions and conduct of the persons participating, together with the ceremony content and associated technical metadata such as timestamps and device information.
3.3 Purpose of Recording. The primary purpose of any recording is to create and deliver to you a private keepsake of your ceremony at your request, and to administer, produce, secure and support that recording service. The recording will not be used for advertising, marketing, publicity or testimonial purposes unless you have given the separate optional publicity consent set out below.
3.4 Retention of Recording. Any recording is hosted in the region selected at booking as described in the Privacy Notice, and will ordinarily be retained for approximately 30 days following its creation or delivery and then deleted from active systems, subject to any retention required or permitted by applicable law, to the resolution of any dispute, and to routine backup cycles from which residual copies are purged or overwritten in the ordinary course. Any statement about the storage or processing location of a recording will reflect the actual arrangements in operation and will not be represented as confined to a single country unless that is factually accurate.
3.5 Access to Recording. Access to any recording is restricted to those systems, processors and persons who reasonably require access in order to provide, produce, secure, support and administer the Service, and each such person or processor is subject to appropriate confidentiality and data-protection obligations. The recording will not be disclosed to any other person except with your consent or as required or permitted by law.
3.6 Guests, Other Participants and Minors. Each adult guest, co-participant and other person whose image, voice or personal data may be captured must receive appropriate notice and provide any consent required by law before recording. Particular care must be taken where a child or minor may appear in or be recorded by the Service. Where a child's personal data may be processed, the Service Provider will require the verifiable consent of a parent or lawful guardian in the manner required by the Digital Personal Data Protection Act, 2023 and the Digital Personal Data Protection Rules, 2025, will not undertake tracking, behavioural monitoring or targeted advertising directed at a child, and may refuse or disable recording where the required conditions cannot be established. A Participant must not knowingly provide or cause the processing of a child's personal data unless the Participant holds the legal authority to do so, and the consent of the person making the booking does not, by itself, authorise the recording of other adults or children.
3.7 Withdrawal of Consent to Recording. You, and any other person who has consented, may withdraw consent to recording in respect of future processing by contacting ashish@ashishduacorporation.com. Such withdrawal takes effect prospectively and is subject to any lawful retention requirement and to processing already lawfully completed before the withdrawal, and does not require deletion of a recording where its retention is required or otherwise permitted by law or is necessary for the establishment, exercise or defence of legal claims.
3.8 Acknowledgement and Consent
❑ I confirm that I have read and understood this Recording & Consent Notice, that I have authority to give this consent, that I have given any required notice to and obtained any required consent from every other adult whose image or voice may be captured, and that I voluntarily consent to the recording of the ceremony as described above.
Separate Optional Publicity Consent
This publicity consent is entirely optional, is separate from the recording consent above, and is not a condition of using the Service. You do not need to give it in order to use the Service or to receive your keepsake.
❑ I separately, voluntarily and specifically consent to Ashish Dua, DuaDesk and Dua Pandit Ji using my ceremony recording, together with my name, image, voice and likeness, for advertising, marketing, publicity, website, social-media, demonstration, case-study and testimonial purposes, worldwide, for the period permitted by applicable law. I understand that this consent is optional and is not a condition of using the Service, that I may withdraw it in respect of future uses at any time by contacting ashish@ashishduacorporation.com, and that withdrawal will not affect any use already lawfully made before my withdrawal takes effect.
4. CANCELLATION & REFUND POLICY
Effective Date: 9 September 2026
4.1 Pre-Ceremony Cancellation. You may cancel a confirmed booking at any time up to 7 days before the scheduled start of the ceremony and, upon such cancellation, you shall be entitled to a refund of the fees you have paid for that booking, less only any charge that has been expressly and clearly disclosed to you in advance as non-refundable and that it is lawful to retain, such as a disclosed booking or processing fee. This provision operates without prejudice to, and in addition to, any greater right of cancellation or refund that you may have under the Consumer Protection Act, 2019 or other applicable consumer law that cannot lawfully be excluded.
4.2 Rescheduling. Subject to availability and to the applicable booking procedure, the Service Provider may, at his reasonable discretion, permit you to reschedule a booking to another available time. Any rescheduling is subject to the terms disclosed at the time and does not extend or restart any cancellation window unless expressly stated.
4.3 Preview or Rehearsal. The use of any preview, demonstration, trial or rehearsal feature does not, of itself, constitute the commencement of the paid live ceremony, and does not by itself extinguish any cancellation or refund right, unless the booking terms expressly provide otherwise and this has been clearly disclosed to you.
4.4 After Commencement of the Ceremony. Once the live ceremony has commenced, the booking fee is generally non-refundable, except where a refund is required by applicable law, where the Service Provider materially fails to provide the Service substantially as described, or where the Service Provider otherwise agrees. Where only part of the Service is materially not provided, any refund may, where appropriate and lawful, be limited to a fair and proportionate part of the fee reflecting the part not provided.
4.5 Technical Failure. If a material technical failure that is attributable to the Service Provider prevents the ceremony from commencing or from being completed, the Service Provider shall, where reasonably practicable, offer you either a rescheduling of the ceremony at no additional charge or an appropriate refund reflecting the extent to which the Service was not provided. The Service Provider is not responsible, and no refund is due on account of, any failure or interruption caused by your own equipment, software, internet connectivity or power, by local conditions at your location, by third-party systems outside the Service Provider's control, or by a force-majeure event, and you accept responsibility for ensuring that your own technical environment is adequate before the ceremony.
4.6 Cancellation by the Service Provider. The Service Provider may cancel, decline, suspend or refuse a booking or session where reasonably necessary for reasons of legal or regulatory compliance, safety, security, prevention or investigation of fraud or abuse, abusive, unlawful or harmful conduct, non-payment, protection of the Proprietary IP or Identity Attributes, or technical impossibility. Where the Service Provider cancels a booking for which you have paid and the cancellation is not attributable to your breach or conduct, any refund due to you shall be provided in accordance with applicable law.
4.7 Refund Processing. Any refund that is approved shall ordinarily be processed to your original payment method within 10 business days of approval, subject to the processing times and procedures of the relevant payment provider, over which the Service Provider has no control. The Service Provider shall not be responsible for delays attributable to the payment provider or to information you have failed to provide.
4.8 Statutory Rights Preserved. Nothing in this Cancellation & Refund Policy limits, excludes or affects any non-waivable consumer or other statutory right that you may have and that cannot lawfully be excluded or limited, including rights under the Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020, and this Policy shall be read and applied consistently with all such rights.
4.9 Fraud and Abuse. Subject to applicable law, the Service Provider may decline, withhold, delay or investigate any refund request where he reasonably suspects fraud, chargeback abuse, duplicate or repeated claims, or material misrepresentation, and may take reasonable steps to verify the request and to protect against loss, provided that any refund lawfully due is not thereby withheld.
5. Marriage Journey — Counselling & Guidance Privacy
Effective Date: 28 September 2026 | Version: 1.0
5.1 What this covers. These terms apply to the Dua Pandit Ji “Marriage Journey” — optional guidance and reflection sessions for couples, before the wedding and through the years that follow, delivered live and, where offered, with the on-screen avatar. This is supportive guidance and reflection; it is not clinical therapy, medical, psychological or legal advice, and is not a substitute for a qualified marriage or family therapist.
5.2 Both partners’ consent. Because these sessions and the information shared are personal and sensitive, we ask for the explicit consent of both partners before a couple joins the Marriage Journey. Participation is voluntary and either partner may withdraw at any time, for the future.
5.3 Information we collect. To arrange and support your sessions we collect: both partners’ names and contact details; your chosen stage, language and preferences; session bookings, attendance and status; and any notes we keep to support your journey. A session is recorded only where you separately enable it, and any recording is treated as described in the Recording & Consent Notice.
5.4 Sensitive information. Marriage-guidance sessions may involve sensitive personal information about your relationship, family, finances or wellbeing. We handle it with particular care, restrict access to those who need it to support you, and do not use it for any purpose other than supporting your journey, except as required or permitted by law.
5.5 Confidentiality within the couple. Guidance in joint sessions is shared between both of you. Where a partner shares something with us individually, we keep it confidential and do not disclose it to the other partner without consent, save where disclosure is necessary to protect a person from harm or is required by law.
5.6 Purpose and no secondary use. We use your information only to arrange, deliver, improve and administer your sessions and to communicate with you about them. We do not sell your information, and we do not use it for advertising, marketing, publicity or testimonials unless you separately consent.
5.7 Where it is held, and for how long. Your information is stored and processed in India. We keep couple and session records for as long as you remain on the Marriage Journey and for a reasonable period afterwards for legitimate and legal purposes, after which we delete or anonymise them, subject to law and routine backup cycles.
5.8 Your rights. Subject to applicable law and verification of your identity, either partner may ask to access their personal data, correct it, withdraw consent to future processing, and request deletion. Withdrawal applies going forward. To exercise a right or raise a concern, contact the Grievance Officer: Ashish Dua, ashish@ashishduacorporation.com, +91 88600 36003 / +91 88600 46004. You may also complain to the competent data-protection authority.
5.9 Safety — this is not emergency support. The Marriage Journey is supportive guidance, not a crisis or emergency service. If you or your partner are in distress, feel unsafe, or are in an emergency, please contact a qualified professional or a local helpline right away. Where a session raises a serious safety concern — including a risk of harm, abuse, or a risk to a child — we may pause guidance and encourage or help you to reach appropriate professional support.
5.10 Responsibility. Ashish Dua (trading as DuaDesk / Dua Pandit Ji) is the person responsible (Data Fiduciary) for the information described here and handles it under this Notice, the Privacy Notice and the Digital Personal Data Protection Act, 2023 and the Digital Personal Data Protection Rules, 2025. The guidance is decision-support and reflection; outcomes depend on the couple, and important decisions remain the couple’s own.
5.11 AI assistance and human oversight. To support continuity across your journey, we may keep a private, evolving record of your sessions and use AI to help prepare summaries, themes and suggestions grounded in your own record. This is decision-support only: a qualified person reviews and approves such summaries and suggestions before they are relied upon or shared, and important guidance remains subject to human judgement. Only reviewed and approved content is retained as part of your journey record.
